Internet Banking Agreement and Disclosure
The following terms and conditions established by Community Bank (the Bank) apply to your use of the Online Banking Services. The Bank reserves the right to modify these terms and conditions at any time, effective upon publication including posting on our Internet Web site. Your use of the Online Banking Services constitutes agreement to these terms and conditions and any subsequent modifications thereof.
Description of Online Banking Service
Community Bank’s Online Banking Service is an electronic service provided via the Internet that permits you authorized access to: Access information about certain deposits and credit accounts for which you are authorized to view information.
The service is provided free of charge. The Bank may offer additional services in the future, which will be subject to these terms and conditions as from time to time modified. If a change in the fee structure for Online Banking Services is planned, fees and charges for this service will not be changed without at least 30 days prior notice and shall be charged to your account.
In order to use the Online Banking Services, you will need to install Internet browser software on your computer if you do not already have it. Modifications to the services in the future may require installation of upgrades to the browser software. You are responsible for the installation, maintenance, and operation of your browser software.
You must have at least one active deposit or loan account with Community Banks to use this service.
The service is generally available 24 hours a day, seven days a week; however, the service may be unavailable from time to time for routine software and hardware maintenance or due to unscheduled down time.
General Terms and Conditions
You agree to indemnify, hold harmless, and defend Community Bank from and against any and all claims, actions, suits, judgments, and expenses (including court costs and reasonable fees of attorneys, accountants, and expert witnesses) at your sole expense, arising from your failure to abide by the restrictions on use of the Online Banking Services set forth herein. You agree that the following uses of the Online Banking Services are strictly prohibited:
In addition, you agree to the following: You acknowledge and understand that access to the account and funds transfer between pre-authorized accounts may be gained via telephone services by any person in possession of your tax identification number and account number; or via Online Banking Services by any person in possession of your access ID code and password. You agree to restrict the distribution of the account numbers, password(s), and your ID code, to authorized personnel. You agree to indemnify and hold Bank harmless from and against any claims, damages or causes of action (including court costs and reasonable fees of attorney(s), accountants, and expert witnesses) arising from unauthorized use of this service.
Transmission of confidential business and sensitive personal information is at your sole risk for access by third parties.
The Bank reserves the right to monitor and review transmissions online and in storage, and to remove or reject any material that the Bank, in its sole discretion, believes may be unlawful or objectionable, without prior notice to you.
The policy of Community Bank about gathering and using customer information provided by you, by using these services, is posted on our Web site and may be amended from time to time. By use of the services you agree to the policy.
Limitations and Liabilities:
Community Bank and its suppliers make no warranties or representations of any kind with respect to the Online Banking Services, whether express or implied, including but not limited to merchantability or fitness for particular purpose and neither the Bank nor the Bank’s suppliers nor anyone else who has been involved in the creation, production or delivery of the Online Banking Services assumes any responsibilities with respect to your use thereof. No oral or written information or advice given by the Bank, the Bank’s suppliers, or any of the Bank’s agents or employees shall create or increase the scope of a warranty or in any way decrease this limitation, and you may not rely on any such information or advice.
You explicitly agree that any liability of Community Bank arising from the provision of Online Banking Services is limited to the fee you paid the Bank for the transaction which gave rise to the alleged liability. You expressly waive any claims for additional, consequential, incidental, compensatory or punitive damages and agree that the damage provisions set forth herein are commercially reasonable in light of the value of such Online Banking Services (including the possibility that the fees you paid hereunder may not be sufficient to fully compensate for all losses, but such fees are in an amount as to make it unfeasible for us to be responsible for greater damages).
Any cause of action concerning the Online Banking Services under this agreement must be commenced within one year after such cause of action has occurred and be filed in the Circuit Court of the State of Illinois.
Fees and Charges
Community Bank will provide this service at no charge. We will not change these rates without at least 30 days prior notice.
Standard security Log On procedures are to request your Online Banking access ID Code and password. You may change your password at anytime while online. You agree that any use of the Online Banking Services indicates your acceptance of the Bank’s security procedures. You agree that any request acted upon in good faith by the Bank in compliance with these security procedures, whether or not authorized by you, shall be treated as your authorized request.
Recording and Records
You authorize the Bank to record electronic transmissions between the Bank and you, or any person acting on your behalf, to keep those records as long as we consider it necessary. If the Bank’s records about a payment are different than your records, our records will govern. The Bank’s records include written or electronic records, recordings, including, but not limited to any payment instructions received by the Bank.
This agreement shall be governed by the law of the State of Illinois and where applicable by federal law.
This Statement is a privacy notice to you, our customer.
Community Bank respects the privacy expectations and rights of its customers regarding financial business.
Community Bank collects, retains, and uses information about individual customers only when we believe it would be useful (and allowed by law) in administering our business and to provide products, services, and other opportunities to customers. This information is obtained from application information, transaction information and consumer report information.
Community Bank will use a customer’s personally identifying information in our normal course of business. Personal information will not be sold or distributed to other parties for marketing purposes.
Community Bank does not disclose any nonpublic personal information about our customers or former customers except as permitted by law.
We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with bank regulations to guard your nonpublic personal information.
Definition of Nonpublic Personal Information:
Nonpublic Personal Information means information about you that we collect in connection with providing a financial product or service s to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records.
This disclosure applies to all customers who have a continuing relationship with us, such as:
